Terms of use
This text describes how the app is meant to be used, written by the people who built it. It has to be read by a lawyer before the app goes on the App Store, and before anyone relies on it.
1. Who this is between
PREJUDGE is made by Prototype Coaching, the Netherlands. By installing or using the app you accept these terms. If you do not accept them, delete the app. Apple also applies its own Licensed Application End User License Agreement to every app on the App Store, and where the two disagree, Apple's terms win.
2. What the app is, and what it is not
PREJUDGE is a practice tool. It times posing rounds, calls poses out loud and films you so you can watch yourself back.
- It is not medical, health or nutrition advice. Posing is physical effort held under tension; if you have any doubt about whether that is safe for you, ask a doctor, not an app.
- It does not judge you and it cannot predict a placing. What a judging panel does on the day is theirs alone.
- The rules data in the app follows published federation rules, which change. Before you compete, check the current official rules of the federation and the show you entered. The app is not a substitute for them.
You use the app at your own risk, and you are responsible for training safely and for where you place your phone while it films.
3. The IFBB Pro League
The round order and pose names in the app are based on the public IFBB Pro League competition rules. PREJUDGE and Prototype Coaching are not affiliated with, endorsed by, sponsored by or approved by the IFBB Pro League, the IFBB or any other federation. Their names are used only to say which published rules a routine follows.
4. Music you import
You can add your own music to a routine. By importing a track you confirm that you own it or have the rights to use it. The app plays it on your phone and, if you export a routine with music, writes it into a file on your phone.
What you then do with that file is yours to answer for. Rights to publish a track, to post it in a video or to play it at a show are not granted by this app, and posting a video with music you have no rights to can get the video taken down. Prototype Coaching is not a party to that and accepts no responsibility for it. If you have no rights to a track, do not import it.
5. Your videos and your content
Everything you record, write or build in the app is yours. It stays on your phone; see the privacy policy. We claim no licence over it and we never see it.
6. Pro, and how the subscription works
Parts of the app need Pro. Pro is an auto renewing subscription sold through the App Store, in these forms:
- Monthly.
- Yearly, with a 7 day free trial for anyone who has not had one before.
- Founder yearly, a launch price that stays with you for as long as the subscription stays active without a gap.
The rules Apple sets for all of these:
- Payment is charged to your Apple Account when you confirm the purchase, and the price and period are shown before you do.
- It renews automatically unless you cancel at least 24 hours before the end of the current period. The renewal is charged within 24 hours before the new period starts.
- Manage or cancel it in iPhone Settings, your name, then Subscriptions. Deleting the app does not cancel anything.
- If you buy a subscription while a free trial is running, the unused part of the trial ends there.
- Refunds are Apple's to give, through reportaproblem.apple.com. We cannot refund an App Store purchase ourselves, although we will help you if something in the app went wrong.
- Your EU right to withdraw within 14 days of a digital purchase is a right against Apple as the seller, and Apple's own terms cover how it is used.
Prices can change. A change never applies to a period you already paid for, and Apple asks you to agree before it charges a higher renewal.
7. Offer codes
Codes we hand out are redeemed through Apple, for the offer they name, once per Apple Account unless stated otherwise, and until their end date. A code has no cash value, is not transferable and cannot be combined with another offer. An offer that ends does not shorten a subscription you already have.
8. Using the app fairly
Do not take the app apart, work around the lock on Pro, resell it, or use it to build a competing product. Do not use it to record other people without their agreement. Federation rules data in the app is there for your own practice, not to be scraped and republished.
9. Availability and changes
The app is given as it is. We do not promise it is free of faults, that every feature stays forever, or that it runs on every future version of iOS. Features can change, and a feature that is still being built is described as such in the app, never sold as finished.
10. Liability
To the extent the law allows, Prototype Coaching is not liable for indirect or consequential loss, for lost recordings, for a missed placing, for injury from training, or for anything arising from music you had no rights to. Nothing here limits liability that cannot be limited, including for death or personal injury caused by negligence, for fraud, or your rights as a consumer under mandatory EU or national law.
11. Ending it
You can stop using the app whenever you want; delete it, and cancel the subscription in iPhone Settings if you have one. We can end access for someone who breaks these terms, for example by tampering with the Pro lock.
12. Law
Dutch law applies. If you are a consumer, this does not take away the protection of the mandatory law of the country you live in, and you may bring a case there.
